The use of an increased amount of brownfield land is positive news considering the challenging targets for new housing. However – a word of caution around previously built land is in order considering the onerous penalties which can be imposed on landowners (even if they did not cause pollution). As noted in our blog at the end of January this year purchasers of brownfield sites would be well advised to consider an environmental survey as a part of their due diligence process.
